About ten years after its entry into force, the banking crisis management framework in Europe is under review: the European Commission has presented a specific proposal to amend the BRRD and the DGSD (CMDI Framework). This initiative follows a wide-ranging debate that has been ongoing for some time about certain shortcomings that have come to light during implementation. In fact, resolution intervention tools have not been applied in practice, except in a few cases, while some notions and definitions need to be revised. The central issue focuses on how the toolkit could be used to manage crises of small and medium-sized banks, which have so far been managed on the basis of procedures and tools decided at the national level. This paper aims to investigate the areas targeted for reform, using as a yardstick the goal of increasing the flexibility of the regulatory framework, as it is considered a fundamental requirement for improving the effectiveness of the overall crisis management system.
