662The essay focuses on the transparency rules adopted to increase the effectiveness of anti-discrimination law and counteract the gender gap in employment both in Italy, with law n. 162/2021 revising the equal opportunities code, and in the European Union, with directive n. 2023/970 on the strengthening of equal pay, with the aim of highlighting possible virtuous convergences and critical issues to be addressed. The author examines transparency in its dual legal dimension, as a duty and as an incentivized choice, and thus the information, measurement and reporting obligations imposed on companies, on the one hand, and the voluntary certification of gender equality, on the other, before warning against the false myths that may arise on the thaumaturgical potential of transparency rules.
