Il contributo è incentrato sul dibattuto tema dei poteri del giudice nella composizione negoziata e nel concordato semplificato. L’ autore prende le mosse dalla considerazione del cambiamento del contesto normativo in cui si è inserita la composizione negoziata e quindi esamina: il rapporto tra la composizione negoziata e il concordato semplificato; gli aspetti distintivi di questo concordato e il significato della sua inclusione tra i possibili sbocchi della composizione negoziata; la natura giuridica, nonché le principali caratteristiche strutturali e funzionali sottolineando il legame con la composizione negoziata della crisi. Il perimetro dei poteri del giudice è strettamente dipendente dalle caratteristiche dei due istituti. The paper focuses on the debated issue of the judge’s powers in negotiated settlement and simplified agreement. The author starts from the consideration of the change in the regulatory context in which the negotiated settlement and the simplified agreement are inserted and then examines: the relationship between negotiated settlement and simplified agreement; the distinctive aspects of the simplified agreement and the meaning of its inclusion within the possible purposes of the negotiated settlement; the legal nature, as well as the main structural and functional characteristics. The scope of the judge’s powers is strictly dependent on the characteristics of the two institutions.
