With judgement 15/2024, the Constitutional Court decided a conflict of attribution and an incidental judgement generated by challenges to the discriminatory nature of a regional law. The ruling assumes particular interest because it establishes the impossibility for the common judge to order an amendment to the implementing regulation, without prior constitutional adjudication, thus enriching with a new «special» case the jurisprudential evolution started since the obiter of ruling 269/2017.
