This essay criticises the Italian Constitutional Court’s ruling no. 135 of 2024 because it interprets in a broad sense the requirement of life-supporting treatment, which, according to an earlier ruling of the Court, is one of the necessary elements to exclude, under Article 580 of the Criminal Code, the punishability of anyone who helps a suffering patient to commit suicide by taking a lethal drug. According to the Court, this requirement includes any treatment practicable by a third party whose omission causes the death of the patient who has exercised the right to refuse medical treatment pursuant to Law No. 219 of 2017. The Constitutional Court considers the individual’s solitary choice to anticipate death, because life no longer seems worthy to him, to be pre-eminent over the solidaristic relational and affective commitment of family members and other caregivers to take care of him, to make him live as peacefully as possible until the natural end of his life. With this interpretation, however, human dignity is emptied of its natural human relational identity, aimed at helping those who suffer, and filled with contingent subjective qualities, degrading life to a res that can be discarded when it loses the qualities of independence, efficiency and productivity.
