The essay focuses on the termination of public contracts by the contracting authority and reflects on the implications arising from the introduction of the «principle of result» within the Italian Public Contracts Code. The study aims to understand whether the «principle of result» imposes a reconstruction in public law terms of the events of the execution phase or whether it instead contributes to confirm the conflictual nature of the relationship and the placement of the termination of public contracts within the framework of private law.
