734In April 2024, the Second Section of the European Court of Human Rights delivered its Judgment in the case Aydin Sefa Akay v. Turkey. Since the Judgment has become final as a consequence of the rejection of the request for referral to the Grand Chamber lodged by Turkey, it seems appropriate to analyze it, in light of its unprecedented findings and conclusions. Indeed, for the first time the Court was requested to declare the violation of Articles 5 and 8 ECHR by Turkey, because its judicial authorities had omitted to consider the immunities of Akay, a judge of the International Mechanism for Criminal Tribunals, in the framework of domestic criminal proceedings instituted against him. Whereas the efforts made by the Court to ensure the respect of the immunities of the international judge are commendable, the reasoning of the Court raises some questions, which are analyzed in this article, on the relationship between the ECHR and international law.
