With these brief reflections on the subject of concessions of large water diversions for hydroelectric purposes, we propose a reconstruction of the state and regional regulations in force in the light of constitutional law 3 of 2001 which has profoundly modified the regime for the distribution of competences and functions between the State and Regions. In particular, regional laws n. 27 of 2020 and n. 24 of 2022 implementing the regulations contained in article 12 of the legislative decree of 16 March 1999, n. 79. Particular attention was paid to the conflict generated by the large concentration of hydroelectric power plants located on regional borders.
