With ruling no. 192/2024, the Constitutional Court made a significant intervention regarding the regulation of differentiated autonomy set out in Law no. 86/2024. The article offers a wide-ranging analysis of the decision, drawing on the artistic technique of «erasure» as a metaphorical lens: the Constitutional Court, in fact, crafted a new legal framework by erasing provisions that were in stark contrast with the Constitution – through targeted rulings of unconstitutionality – and by reinterpreting numerous other aspects, which also appeared misaligned with the constitutional text, in a manner consistent with constitutional principles. The research therefore aims to critically reconstruct the differentiation process as it stands following the ruling, also shedding light on certain unresolved issues. In its conclusions, the study reflects on the meaning to be ascribed to the Constitutional Court’s intervention and on the incorporation of the «rewritten» differentiated autonomy into the constitutional framework.
