The article examines the statements contained in Judgment No. 145 of 2024 of the Constitutional Court regarding the regularisation of the void notification of the recourse of constitutional legitimacy where the respondent appears in court and makes defenses on the merits. The novelty of this assertion is highlighted through an examination of past constitutional case law, both referring to judgments of constitutional legitimacy by recourse and referring to conflicts of attribution between State and Regions. The paper places this – unstated – overruling of precedents on the subject of the regularisation of void notification (regularisation that prior to this decision was excluded) in the context of the supplementary sources of the constitutional process, and thus the Administrative Process Code, as it results from the corrective interventions of the Constitutional Court itself, and the Civil Procedure Code. On the basis of the principles contained in the common procedural rules and their compatibility with the constitutional process, the article tries to hypothesize the possible developments of this jurisprudential turn.
