Starting from the premise that rights are the result of a complex historical process and that the recognition of subjects of law is confronted with theoretical contexts for their recognition, this article examines how the legal subjectivity (capacity, in the language of civil lawyers) of the insane (alienated) was affirmed in Brazil during the First Republic (19th to 20th centuries), in a scenario in which rights had to reckon with evolutionism, scientism and racism, also present in the legal and medical theories of the period.
