The second half of the last century contributed with an important achievement for the human being: the recognition that access to water is a human right. This right, especially in Brazil, has been at risk due to the unbridled release of pesticides and the non-compliance, when these releases, of the constitutional principle of precaution. This paper presents elements that contribute to this discussion, among which stand out the normative bases that support the human right to water and, on the other hand, the dismantling of government initiatives to control the use of pesticides and threats to availability of drinking water. Based on these scenarios, the role of the State as responsible for the protection of the environment is discussed and measures are presented that can compose public policies to face the reality presented and contribute to guaranteeing access to safe water.
