The topic treated concerns not the circumstance in which the State wants to prepare a good environmental policy, but rather that in which the State wants to avoid this duty, as happened in Brazil during the government of President Jais Bolsonaro, who acted actively, with legislative and administrative acts, to make the legislation on pesticides more tolerant. Talking about the State's objective of preparing an adequate environmental policy to protect its citizens, in this case a policy of control of the use of pesticides, in terms of a duty is the result that is achieved if it is placed in the context of respect for rights, in particular human rights. For this reason, in this contribution I will focus, through the analysis of some cases in the field of climate change, on the potential that the language of rights, and in particular of human rights, has to keep the State bound even when politics wants to go in a different direction, and on the tools useful to achieve this goal.
