178This article is part of an ongoing research project aiming to demonstrate the violation of women's rights due to violence on their subjectivity when they are inserted into the judicial scene as parties and the impossibility of acting as adversaries, participating in the hearing in such a way as to influence the construction of the judicial decision. The use of aesthetics is a theoretical strategy that aims to demonstrate the errors and deviations of modern procedural rationality, in order to seek a course correction for current abuses of fundamental rights and guarantees. The objective is to propose a new model for the contradictory actions of people involved in the criminal process, whose characteristic is plasticity, understood as a procedural adaptation of procedural documents to allow women to participate in symmetric equality, especially when they are included as victims.
