Since the promulgation of d.lgs. 231/2001 presented the interpretative problem, due to the general indication of its recipients, as to its applicability to the Not for Profit Entities. The 2017 legislative reform of the Third Sector offered new arguments in favor of the thesis of the applicability of the Decree 231 to this organizations. Nevertheless, peculiar aspects and recurring issues characterize the elaboration and enforcement of the Compliance Program of crime prevention specified for such particular entities. The following is an overview of the implications, doubts and possible solutions for the elaboration of an appropriate Model 231, effective and suitable for the exempted of their administrative liability depending on a predicate crime. And also related to the new Sustainability legislation.
