Judgment n. 195/2024 carried out the difficult task of balancing the State’s financial interests with the protection of regional prerogatives, especially with regard to ensuring social spending, and healthcare in particular. The reasons for financial consolidation – which the recently enacted fiscal rules in the Union require of Member States – continue to serve as the basis and justification for diverting resources from the Regions, a practice that aligns poorly with Article 119 of the Constitution.
