Starting from an "obiter dictum" contained in Judgment no. 195 of 2024, the author questions the distinction between expenditure that is not necessary and expenditure that is necessary to guarantee the primary needs of human beings. According to the Constitutional Court, expenditure necessary to guarantee the right to health can no longer be reduced without equivalent resources being sought elsewhere. For the author, it is precisely this passage that marks an advancement in the Court’s jurisprudence with respect to the concept of «constitutionally necessary expenditure».
