141In a Master’s dissertation completed in 1991 during the pre-constitutional era, I accepted the traditional narrative pertaining to the Islamic law of testate and intestate succession. I defended the discriminatory half share of inheritance afforded to women and proffered tools to augment or equalise them. Thirty-four years later, I revisit the topic to test the traditional narrative and to ascertain whether my defence still holds true and whether it would withstand judicial scrutiny if challenged in a post-constitutional South Africa. In doing so, I analyse more recent literature and case law and offer some proposals and recommendations for the way forward.
