This essay traces the evolution of the relationship between fundamental rights and the market within the legal framework of the European Union, challenging the oppositional paradigm that sees rights and the market as inevitably in conflict. Starting from a historical perspective, it shows how European economic integration – far from being antagonistic to the constitutionalism of rights – has, at various stages, served as a vehicle for their realization and effectiveness. Through an analysis of case law and the most recent normative instruments of sectoral harmonization, the essay highlights the central role that economic freedoms, the principles of competition and non-discrimination, as well as corporate due diligence obligations, have played in the concretization of fundamental rights. It also underscores the contribution that the private enforcement of fundamental rights can make in the prevention and repression of micro-conflicts typical of certain domains. What emerges is a reading of the market as a regulated and accountable space, capable of offering innovative guarantees that enhance the specific role of enterprises in providing non-judicial protection of rights.
