591The essay aims to demonstrate that reliance on the notion of disinformation – when employed as a regulatory category within public law to identify content whose circulation must be restricted by digital platforms – proves to be in conflict with the protection of the freedom of expression. The analysis begins by reconstructing the main definitional features of the concept of disinformation and exploring their interaction with freedom of expression, drawing on the construct of the "ideal" (or "democratic") public order as developed in the Italian Constitutional Court’s case law and later criticized in legal scholarship. Against this background, the article evaluates the extent to which the framework established by Regulation (EU) 2022/2065 (the so-called Digital Services Act) falls outside the normative parameters within which limitations on freedom of expression by public authorities may be considered constitutionally legitimate. The article concludes with critical reflections on the persuasiveness of the rationales advanced in support of this more restrictive regime, which are typically grounded in the specificities of the digital information environment, and in particular the structural dynamics of social media platforms.
