The essay examines the principle of legality into the multilevel constitutionalism, starting from the perspective of the system of sources and the correlated profile of the rights protection against public powers. In particular, the Author emphasises the «crisis» of the principle of legality, as traditionally understood, in the constitutional state, because of, on the one hand, the relations between Courts and Parliaments – in the light of the evanescence of the absolute primacy of the law and the consolidated proliferation of centres of normative production – and, on the other, the relations between supranational order and national law.
