This article examines the Umbrian Regional Law 2/2023 on shared administration within the broader evolution of subsidiarity-based governance in Italy. The law aims to promote structured collaboration between public administrations and Third Sector Entities (TSEs) – that is, formally registered organizations pursuing civic and social purposes under Italian law for non-profit goals – through the instruments of co-programming and co-planning, thereby advancing a model of administrative action grounded in shared responsibility and civic participation. Nonetheless, by restricting the scope of participation to formally recognized TSEs, the law risks excluding active citizens and informal civic groups, whose engagement is essential to a pluralist and inclusive vision of the general interest. Furthermore, the lack of implementing tools and limited application in practice hinder the law’s transformative ambition. The paper argues that shared administration should be understood as a structural model of democratic innovation and civic solidarity, requiring a public administrative organisation capable of sustaining, coordinating and integrating both institutional and social actors in the pursuit of constitutional goals.
