329This essay analyzes the crisis of democracy starting from neoliberal ideological influences. The notion of the "economic constitution" allows to highlight how neoliberal economic theory has influenced constitutional thought and public law. By tracing the conceptual-historical evolution of «economic constitution», it underlines how the last few decades have marked a shift from an «inflationary economic constitution», which defined the face of postwar constitutional democracy, to a «neoliberal economic constitution». Engaging with the theoretical work of Friedrich A. Hayek the article argues how the notion of the «constitution of liberty» defines the characters of the neoliberal framework and its relationship to law.
