The article examines the modalities, objectives and problems of electronic voting, assessing its compatibility with constitutional principles and guarantees in the Italian legal system. In a technologically advanced society, the digitisation of democratic processes, such as e-voting, raises questions about its nudging role and the impact of technology as a protagonist in modern constitutional democracies. Although the introduction of electronic voting systems may improve voter registration and vote counting, and potentially facilitate greater participation, it also entails risks related to transparency, security and algorithmic influence that could circumscribe or manipulate free electoral expression, transforming technology from a tool of progress to a conditioning and limiting force.
