In this article, the Author reflects on Mariangela Ripoli’s contribution to the rediscovery of the vindicatory nature of punishment, and of imprisonment. Starting from this realist position, Ripoli is able to point out the antinomy between punishment and human rights, and to theorize, in a truly original way, an only potential, and sometimes conflictual space for criminological treatment: the challenge, which this contribution develops, lies in the hazard of constructing "enclaves" for treatment, i.e. protected settings, a sort of breathable air bubbles that deny in reality the factuality of imprisonment. In this perspective, the possibility of teaching criminal justice and penitentiary law with a focus on promoting human rights and building breathable spaces in prisons is discussed.
