473This paper explores the contemporary debate on the "commons", focusing on its conceptual, historical, and theoretical dimensions, particularly within the Italian and Spanish contexts. It examines how the resurgence of the term in recent decades stems from a broader critique of neoliberalism, privatization, and individualistic legal paradigms. Through an analysis of key contributions, the paper identifies the multiple references that inform the field. It proposes a fourfold classification of the commons by theoretical perspective, by the characteristics of goods, by the subjects to whom they belong, and by narrative frameworks. The study concludes that the commons do not constitute a homogeneous category but rather a plural and dynamic field of inquiry that challenges the public/private dichotomy and redefines the relationship between law, community, and collective governance.
