495This contribution aims to show the constitutional dimension of the debate on the commons, as a transformative response, beyond what is established/constituted. The starting point, especially with regard to constitutional reflection, would be found in the proven inadequacy of the dominant constitutional discourse, both in terms of rights and powers (the dogmatic dimension and the organic dimension) in the face of the expansion of the dynamics of private (and also public) enclosure of collective resources and services. As a concrete example, the text takes the case of the construction of the right to housing, whose obstacles and limitations fully justify the need to propose a reconfiguration of the very nature of the right, through different forms of communalisation of its content and guarantees.
