This paper retraces the Italian debate surrounding the category of the commons and offers a reconstruction of its emergence and main applications in order to assess its theoretical and practical legacy. Nearly fifteen years after the reform efforts of Book III of the Civil Code, which aimed to introduce the legal definition of the commons, it is now possible to draw some evaluative conclusions about this experience, also with the aim of highlighting the still unresolved issues that deserve further exploration.
