58This article explores the public law issues surrounding urban planning in Milan during the Reconstruction (1945-1946). It emphasizes that urbanism is inherently a political and constitutional discipline, linked to property rights, expropriation, and social welfare policies. Drawing from R. Busi’s volume, "1944-1946. Piani per lo sviluppo della Milano del futuro, ovvero La solitudine del tecnico" (2020), the analysis focuses on the intense post-war activity to develop the General Master Plan (PRG). It highlights the conflict between the «super-technical» moderate position led by Cesare Chiodi and the left-leaning political choice that assigned the PRG direction to Piero Bottoni. The text also critiques the democratic Italian Republic’s failure to implement advanced provisions of the 1942 Urban Planning Law, especially regarding the capture of development value and its impact on affordable housing.
