The aim of this paper is to determine whether or not prison rights are effectively protected. Starting from the formal recognition of the legal subjectivity of detainees, and after reviewing the key steps towards the introduction of judicial remedies, we will examine, from the introduction of the remedies to the end of 2019, the measures taken by the Surveillance Judges in Florence based on their appropriateness to respect the rights of prisoners. Finally, we will argue that the tendency of judges to prefer restrictive interpretations is, at the same time, the effect and cause of a legal culture not yet open for an adequate safeguarding of the dignity of prisoners.
