This paper aims to critically evaluate the report of the UN Independent International Commission of Inquiry on the Occupied Palestinian Territory through a historical analysis. Key points concern the type of documentation presented as evidence by the Commission, the historical context in which the crimes occurred, and the discussion of the Israeli state’s intent to destroy the Palestinian community in Gaza as such. The conclusion, also based on a historical comparison with other genocides deemed such by international tribunals, is that the Commission’s findings are not convincing, as they were in previous reports that found the existence of war crimes and crimes against humanity.
