This article analyses the emergence of an implicit model of social justice in the case law of the European Court of Human Rights, notwithstanding the absence of a formal catalogue of social and economic rights in the Convention. It argues that the Court has constructed a coherent framework to protect against poverty and social exclusion, which rests on two interconnected pillars. The first pillar, procedural in nature, aims to guarantee inclusion and equal treatment. It removes economic barriers to the effective access to rights (such as the right to a court) and combats direct and indirect discrimination that exacerbates the marginalisation of vulnerable groups. The second pillar, substantive in nature, protects an irreducible core of human dignity. It is triggered when material deprivation reaches a threshold of severity so as to constitute inhuman or degrading treatment (Art. 3), to compromise private and family life (Art. 8), or to endanger life itself (Art. 2). This approach, grounded in the notion of 'static dignity', defines a 'minimum threshold of humanity' below which no State can allow individuals to fall. Through the evolutive interpretation of civil and political rights, the ECtHR does not create new social rights but rather ensures that existing rights are practical and effective for all. The article concludes that, by operating within its mandate, the Court acts as a catalyst for social cohesion in Europe, indirectly strengthening the protection of the most vulnerable within national legal orders.
