745The principle of Common but Differentiated Responsibilities and Respective Capabilities (CBDR-RC-NC) plays a key role in international climate law by promoting a fair allocation of obligations based on States’ historical contributions and capacities. Although its scope has recently been challenged, international case law – particularly from the ICJ – appears to reaffirm its original content and legal relevance. This contribution argues that CBDR-RC-NC has evolved into a general principle of international environmental law, serving as both a mechanism of distributive justice and a tool for social cohesion. It further requires Global North countries to support the Global South through finance, technology, and reparation for climate-related loss and damage.
