This paper examines the principle of permanent sovereignty over natural resources and its application as a dual right of States and peoples, through the prism of social cohesion. Originally conceived during the decolonisation era, the principle has, over time, shifted from a dual entitlement (State and people) toward an apparently exclusive State prerogative. In this context, despite the proliferation of international norms promoting 'sustainable' resource management and use, the triple planetary crisis of climate change, pollution, and biodiversity loss continues to unfold, while socio-ecological conflicts related to natural resources intensify, leading to the so-called 'resource curse'. Critically acknowledging the role of international law in perpetuating the current state of affairs, the study explores whether the discipline can instead foster social cohesion and justice by re-evaluating the collective right of all peoples to dispose of their natural wealth and resources. After systematising peoples’ rights over natural resources as an embodiment of self-determination, the work focuses on the right to free, prior and informed consent for indigenous and tribal peoples as a potentially transformative tool for navigating the tension between original entitlements over natural resources.
