This paper investigates the interplay between horizontal and vertical subsidiarity in the regulation of the Third Sector, situating it within the broader framework of Italian regionalism. The 2017 reform and the establishment of the National Third Sector Register (RUNTS) marked a turning point in the governance of civic organizations, requiring a clearer definition of the relationship between state and regional legislation. The analysis of regional legislation reveals a highly diversified landscape: some Regions (Emilia-Romagna, Marche, Molise, Piemonte, Puglia, Toscana) have adopted comprehensive laws implementing the Third Sector Code; others have focused on specific institutions (Umbria). These normative frameworks address key issues, including the delimitation between Third Sector Entities and other organizations, systems of representation, the regulation of co-programming and co-planning as well as promotional and support measures. The plurality of regional approaches confirms that regional legislation constitutes a decisive testing ground for the reform of the Third Sector. Within this scenario, subsidiarity emerges not only as a principle guiding the allocation of competences, but also as a constitutional foundation legitimizing the action of Third Sector organizations within a multilevel governance system.
