The difficulties in managing migratory flows are partly attributable to a disorganized and minimally harmonized regulation, to allow member states to balance reception with security needs. The hardship is exacerbated in the migration of unaccompanied foreign minors, a phenomenon growing in frequency and intensity. The judgements of European courts on direct and indirect violations of human rights document the ineffectiveness of the protection and representation function attributed to the unpaid guardian, an office distinct from civil guardianship, but unattractive due to the obvious contradiction between the professionalism of the function and the voluntary nature of the office.
