This paper intends to analyze, in light of the recent judgment of the European Court of Human Rights in the case of Locascia and others v. Italy, the violations committed by Italy with respect to art. 8 of the European Convention on Human Rights and Fundamental Freedoms. The commentary aims to verify the current landing point of conventional jurisprudence regarding the protection of the environment with particular reference to the "waste emergency" declared in the Campania region, as well as relationship between the violation of the "right to life" and that of the "right to respect for private and family life". In addition, some brief forward-looking considerations will be proposed regarding the proof of the causal link between damage from exposure to pollutants and injury to the good of life.
