68The recent proposal for a regulation in matters of filiation follows the
model set out by the so-called new-generation EU regulations adopted in the field of
judicial cooperation in civil matters, since it aims to introduce a comprehensive set
of rules addressing the various private international law issues arising in the subject
concerned. The proposal aims to introduce a very broad set of rules of jurisdiction,
pursuing the aim of offering the child the highest opportunities of access to a court
where his or her filiation may be established, while not always striking a fair balance
with the concurrent goal of ensuring an adequate link of proximity between the forum
and the legal sphere of the child. The choice of providing for a very broad range of
alternative fora and the coexistence of an autonomous subsidiary forum, as well as a
forum necessitatis, with a reference to national rules of jurisdiction appears
particularly critical in this respect. In fact, offering an excessively broad range of
available fora risks endangering the foreseeability of jurisdiction and favouring
forum shopping, something which should not be encouraged in a sensible domain
such as filiation.
