The rules on the free movement of persons foster frequent movements of European citizens, leading to a transnational character of families. The traditional model, consisting of two persons of different sexes bound by marriage, is gradually falling apart, leaving room for the large-scale spread of new family models. Ensuring cross-border continuity of family status within the territory of the Union has always raised a number of legal issues that are not straightforward to solve. Very often it is the rights of those involved that suffer, as they see the margins of protection granted widening or narrowing, to the detriment of uniformity and legal certainty. Recently, the European Commission took action by presenting a proposal for a regulation on parenthood. The proposal aims to introduce unified rules in terms of applicable law, jurisdiction, recognition and enforcement of acts and decisions, albeit with an effort that does not always prove to be coherent. The contribution examines the regulation of applicable law in the proposal and its possible limitations.
