137The paper aims to describe the residual scope of application of the public
policy exception in the field of the proposal for an EU regulation on parenthood
adopted by the European Commission on December 7, 2022. Through the analysis of
the original text of the proposal, as combined with the amendments adopted by the
European Parliament in its opinion delivered on December 14, 2023, the article
identifies two « counter-limits » to the public policy exception of the EU Member
States. Besides the « internal and orthodox » limitation founded on the principle of
the best interest of the child, an additional counter-limit emerges: a « supranational
heterodox counter-limit », based upon Article 21 of the Charter of fundamental rights
of the EU (principle of non-discrimination). The investigation is supported also by
the examination of the various proposals developed in the permanent parliamentary
committees which have preceded the opinion of the European Parliament. The paper
also addresses an "implied and non-codified" counter-limit, deriving from the wellestablished case-law of the European Court of Human Rights on surrogacy. Finally,
the paper assesses whether the way in which the brand-new European certificate of
parenthood has been shaped under the proposal may lead to a further "external"
counter-limit, which might compromise the protection of the national fundamental
principles protected by the public policy of the EU Member States.
