The case law of the Court of Justice of the European Union in the landmark cases Coman and Pancharevo affirmed the obligation of Member States to recognise parenthood established in other Member States, albeit with the aim of guaranteeing the exercise of the rights inherent to freedom of movement. The proposal for a regulation under analysis aims to introduce special judicial cooperation mechanisms necessary in order to ensure the protection of the fundamental rights involved. The high level of globalisation and the increasing migratory flows to European territory from third countries impose a reflection on the relations between the proposal for a regulation and the legal orders of third States, which this contribution aims to highlight, with specific reference to the aspects of jurisdiction, applicable law and recognition and enforcement of judicial decisions.
