The article aims to analyse the new "integrated border procedure" introduced by the New Pact on Migration and Asylum. The article argues that the Pact creates a new regime based not on the legality of the third-country national's stay, but on the concept of authorisation to enter the territory. Through the use of "legal fictions", such as the fiction of non-entry, such a regime allows to derogate from the ordinary legal framework related to fundamental rights of migrants at the borders. The contribution claims that such a derogatory regime was already part of EU migration law, albeit framed as exceptional and residual. In this light, the article examines the issue of "admission on national territory" in European migration law, analysing its consequences on the legal status of "unadmitted migrants" at the borders, in the ECtHR jurisprudence and in EU law, before and after the New pact.
