57The main aim of this article is to show how European jurisprudence has
shaped, at the same time as the regulations, the specific content of the freedom of
movement and the free residence of European citizens in the territory of the EU
Member States. The focus of this reflection is the ruling of the CJEU of 22 February
2024, in which the CJEU analyses whether a Member State can restrict the issuance
of a travel document to its nationals who have exercised the right of free movement
and free residence, for the mere fact of residing outside its national territory, creating
discriminatory treatment between nationals resident in its own State and nationals
resident in other EU States. To do so, it is necessary to understand how the CJEU has
shaped this right deduced from the current regulations, both primary and secondary,
taking into account the case and the procedure followed.
