Mutual recognition has always been a key element in the process of European integration. Over the years, the application of mutual recognition has found diversified declinations due to the different modulation between "integration and "distinction" between state systems in the areas of EU competence. The paper, through the analysis of recent case law of the Court of Justice, intends to question the role that mutual recognition should have in the common asylum system to guarantee the rights and freedoms acquired by individuals. Indeed, the inapplicability of that principle in a system defined as "incomplete" raises a problem of systemic consistency between a legal qualification of the right of asylum, which is being increasingly defined in the case law of the Court, and the effective enjoyment of rights associated with that status.
