This paper analyzes two aspects of the Italy-Albania Protocol for the strengthening of cooperation in migration matters, signed on November 6, 2023. First, having identified the functions of the areas granted by Albania to Italy for the management of migrants, the study questions the applicable law. Based on the extraterritorialization of Italian law put in place through the Protocol the contribution questions whether and to what extent European Union law applies. Secondly, having clarified the list of persons destined to be taken to the "areas" – taking into account for this purpose the very recent jurisprudential developments on the "safe countries of origin," the outcomes of which could call into question the very raison d'être of the Protocol – the investigation moves on to analyze the legal status they will come to assume, the status of detention, pointing out the conditions of legitimacy and observing its first application.
