The EU Strategy on the Rights of the Child, adopted on 24 March 2021, places the fight against child poverty and the promotion of equal opportunities for children at risk of social exclusion among the fundamental objectives of EU policies. Although it is acknowledged that this latter category includes children from a migrant background, who, also due to additional risk factors, are victims of a «profound inequality of opportunity» and although the Commission is committed to ensuring the integration of the child rights perspective in all relevant legislation, the New Pact on migration and asylum represents in this respect a dangerous retreat in the protection of this category of applicants. In particular, it expands the scope of the special procedures for processing asylum applications (the accelerated examination procedure and the asylum border procedure), which, in the name of greater speed, will also be applied to families with minor children, leading to a de facto detention of thousands of child migrants. Furthermore, the reform of the screening regulation and the Eurodac regulation will expand the possibility of checks and the collection of biometric data of minors, aimed at more effectively identifying those arriving on EU territory.
