209The new Directive on work carried out through digital platforms has been accompanied by a long process of theoretical analysis along with a meaningful evolution in the case-law, especially at national level, due to the rich and varied practice present in almost any of the EU Member States (for Italy, the ruling issued by Court of Cassation in the Foodora case is especially meaningful). The topic suggests many considerations from different points of view, and in the first place, of course, with regard to the developments of labor law in the face of the continous advancements of technological innovation. The paper proposes some reflections in the context of studies mainly devoted to European Union law. More precisely, we will touch upon issues on the choice of the relevant directive's legal basis and the not always clear qualification of the activities covered by the new legislation as true labor activities or, alternatively, as activities to be seen through the lens of the freedom to provide services.
