This paper focuses essentially on three main points. The first concerns the nature of migration as an inviolable right of the individual; the second addresses the distinction between migrants and immigrants—whereby the former (those in transit) must be granted aid and assistance, and the latter (those who settle permanently within the territory of the State) must be granted reception; the third highlights the equally significant role that the legal framework concerning both migrants and immigrants (particularly the former) plays, both in the dynamics of legislative processes and in judicial proceedings—especially in constitutional adjudications concerning such legal provisions.
