295This contribution examines the phenomenon of online disinformation as a "hybrid threat" to the democratic resilience of the European Union and the legal orders of its Member States. After clarifying the definitional profiles and distinctions between disinformation, misinformation, and malinformation, the analysis highlights how the systemic dissemination of false or misleading content – particularly through social media platforms – can undermine the integrity of public debate and negatively affect electoral processes. The study focuses on the regulatory responses adopted at the European level, with particular attention to Regulation (EU) 2022/2065 (Digital Services Act) and Regulation (EU) 2024/900 on political advertising, both aimed at strengthening transparency, the accountability of digital intermediaries, and the protection of fundamental rights. In conclusion, it is argued that an effective strategy to counter disinformation should rely not on censorial approaches, but rather on the imposition of transparency obligations that enable users to exercise informed and critical control over information – an essential condition for the proper functioning of democracy in today's digital ecosystem.
