The European Commission has proposed a new EU Space Act, based on the legal basis of Article 114 TFEU, with the aim of harmonising national legislation on safety, resilience and sustainability in relation to space activities in the Union's internal market in this sector. The proposed Regulation aims to provide clear and uniform rules for economic operators, including private ones, also with a view to encouraging investment, while respecting the sovereign prerogatives of Member States related to the protection of national security requirements. This paper analyses the new regulation and the challenges it presents, first placing it in the context of the Union's legal system in relation to cross-cutting measures. It then analyses its relationship with the recent Italian Law 789/25 on the space economy. Finally, some concluding remarks are offered.
